The right wing is making a huge deal about the fact that Obama has obeyed the law (the Anti-Deficiency Act) and shut down the parks and monuments. The law — passed by Congress in 1870 — says he cannot spend money keeping them open unless said money is authorized by Congress. Congress (the House specifically) has authorized no such money. So the law says Obama can’t keep’em open. Amendments to the ADA say that he can protect them with guards to keep them safe, but that’s all that the law allows. Opening them is in Congress’s court now.
The right wingers making a big deal about the parks and monuments know this. So why are they making such a big deal about the fact that Obama is obeying the law? Hint:
Yes. It’s a trap. If Obama breaks the law and illegally opens the parks and monuments without Congressional authorization of money to operate them, then they can impeach Obama. And while the impeachment proceeding would stop in the Senate, it would still be months worth of political theater and political capital in the bank back home in Wingnuttistan.
Something to think about, when you find yourself reflexively agreeing “it makes no sense that they’re spending more money closing the WW2 memorial than they would spend if it were open!” Even if it were true, the law is the law — and the law says that the House could impeach Obama if he handed brooms to those guards and told’em to sweep the WW2 memorial plaza rather than guard it.
